In this regard, the status quo will be summarised and the mechanisms international law has at its disposal will be explored in order to propose a solution to the issue going forward, which would herewith provide adequate clarification to states so as to prevent further disputes over the practice in the future. In the context of this Chapter, a determination will be made as to whether general international law supports a right to diplomatic asylum. This chapter will prove particularly important in establishing whether a customary international law rule in favour of the practice exists, for which a practice element is constitutive, as well as in ascertaining the key features of diplomatic asylum in this context.

In the course of this chapter, selected historical practice from Latin America will also be illustrated. It also analyses counter-terrorism and its impact.Ĭhapter 3 will detail the history of the practice in the context of diplomatic law: commencing with its foundations in the fifteenth century with the new idea of the inviolability of the ambassador’s dwelling place, through to its continuation in the sixteenth and seventeenth centuries, its subsequent fall from favour by reason of abuse of the practice, the continuation of the practice in the eighteenth century, its reservation for cases of political disturbance in which life is in danger, asylum in the context of (merchant) ships and warships (so-called naval asylum), in the context of Latin America in particular in its states’ struggles for independence, the extent to which the practice was codified on a universal level by the Vienna Convention on Diplomatic Relations up to the numerous twentieth century attempts of the ILC to codify the issue.
